Russian Federation makes changes in the Decree of the Government of the Russian Federation No. 353 "On the specifics of licensing activities in the Russian Federation in 2022"
On March 14, 2022, Decree of the Government of the Russian Federation No. 353 "On the specifics of licensing activities in the Russian Federation in 2022" came into force.
On 13th of July (Decree of the Government of the Russian Federation No. 1249) and 31st of August (Decree of the Government of the Russian Federation No. 1522) the following changes in Annex 18 (Conformity assessment) of the Government of the Russian Federation No. 353 were made:
- Russia Customs does not require permission to use certificates/declarations
It is not required to provide permission (PoA) to Russian Customs to use conformity assessment documents (certificates, declarations) when imported products into the territory of the Russian Federation (from 13th of July, 2022).
- It is allowed to label products with circulation mark (STR) or conformity mark (RST)
Until March 01, 2023, it is allowed to mark products with circulation mark or conformity mark for products pass conformity approval in accordance with the Federal Law «On technical regulation» (cl.3 paragraph 46) (from 13th of July, 2022).
- The period when certification can be replaced by declaration extended
Certification and declaration (based on tests carried out by an accredited testing laboratory) can be replaced by declaration based on the applicant's own evidences from March 21, 2022 to September 1, 2023 for a certain list of products imported into the territory of the Russian Federation (from 31st of August, 2022).
- National accreditation body could suspend and cancel declaration based on the applicant's own evidences
The declarations registered in accordance with cl. 6 of the Decree of the Government of the Russian Federation No. 353 could be suspended by national accreditation body if:
- documents and information in the registered declaration do not meet the requirements of the Decree No. 353;
- declaration is registered for products for which it is not permitted to register such declarations.
Applicant needs to cancel declaration or to provide national accreditation body with the additional information. If provided information satisfies national accreditation body the declaration will be resumed.
National accreditation body make a decision to invalidate DoC if:
-applicant did not provide additional information within 15 days from the national accreditation body request or additional information unsatisfactory;
It is not allowed to release products into circulation in the Russian Federation (including import) if declaration registered in accordance with cl. 6 of the Decree of the Government of the Russian Federation No. 353 was suspended, cancelled or declared invalid.
