Russian Simple approval procedures are still applicable for 1 year more
Russian Government decided to prolong Decree of the Government of the Russian Federation No. 353 "On the specifics of licensing activities in the Russian Federation" until September 1, 2025 - Government Resolution 1196 of August 31, 2024
It means that it is still possible to use simplified product conformity assessment procedure to release products into circulation in the Russian Federation:
- Products for which it is not required to provide certificates and declarations of conformity
Clause 4а of Annex 18 to Decree 353 establishes the types of products for which it is not required to provide documents on conformity assessment and even information about such documents when imported into the territory of the Russian Federation (spare parts, accessories, components, raw materials, etc.).
- Russian Customs don't require original conformity assessment documents
Confirmation of compliance is carried out by submitting information of documents (number of certificate or declaration) to the Customs Authorities, without providing original documents (cl. 4b).
- It is allowed not to label products with EAC mark
It is allowed to import products into the Russian Federation without marking with EAC mark. This applies only to products intended for circulation in the territory of the Russian Federation.
EAC mark should be put on products that passed mandatory conformity approval according to Eurasian Economic Union Technical Regulations (CU TR/EAEU TR) before the products sale to customers (Cl. 5).
- Certification can be replaced by declaration
Certification and declaration (based on tests carried out by an accredited testing laboratory) can be replaced by declaration based on the applicant's own evidences for a certain list of products imported into the territory of the Russian Federation. Registration of declarations is allowed only on behalf of applicants from the Russian Federation. Such declarations can only be issued for a batch or a single product with a validity period of 6 months from the date of registration (Cl. 6).
Products for which a “simplified” declaration is issued are not marked with EAC mark, and can only be put into circulation on the territory of the Russian Federation.
Please note an important feature of the simplified declaration scheme.
Thus, after registration a declaration under simplified scheme and bringing the products to the market, manufacturers and importers have six months to confirm products compliance with the requirements of the EAEU Technical Regulations (CU TR/EAEU TR) or the requirements of Resolution 2425. In other words, it is mandatory to get EAC CoC.
Otherwise, products cannot be sold to the end customers.
Moreover, if batch of products already sold it is still mandatory to get EAC CoC within 6 months after registration a declaration under simplified scheme.
Decree of the Government of the Russian Federation No. 353 doesn’t cancel the conformity assessment procedure in EAEU countries. This document gives some relief when importing products into the territory of the Russian Federation.
